On returning a petition to the petitioner

The Constitutional Court of the Republic of Lithuania, in its procedural sitting, having considered a report made by a justice regarding the results of the preliminary investigation in the case on the petition requesting an investigation into the compliance of Article 25 of Chapter 5 of Part II of the Statute of the Seimas of the Republic of Lithuania with the provision of Paragraph 4 of Article 59 of the Constitution of the Republic of Lithuania, has established the following:

The petition of 30 June 1993 of a group of one-fifth members of the Seimas of the Republic of Lithuania, the petitioner, requesting an investigation into the compliance of Article 25 of Chapter 5 of Part II of the Statute of the Seimas of the Republic of Lithuania with the provision of Paragraph 4 of Article 59 of the Constitution of the Republic of Lithuania falls under the jurisdiction of the Constitutional Court. In the petition, Seimas member Tautvydas Lideikis was indicated as the representative of the petitioner, upon whose death a letter of authorisation for Seimas member Andrius Kubilius signed by six members of this group of members of the Seimas was received. However, Paragraph 1 of Article 32 and Item 1 of Paragraph 1 of Article 66 of the Law on the Constitutional Court of the Republic of Lithuania provides that a group of members of the Seimas elects its own representative (representatives) by itself and indicates this fact in the petition signed by all applying members of the Seimas, whilst their signatures are approved by the Speaker of the Seimas or his Deputy.

Conforming to Paragraph 4 of Article 26 of the Law on the Constitutional Court of the Republic of Lithuania, the Court adopts the following decision:

To return the petition to the petitioner.
