On refusing to consider a petition

The Constitutional Court of the Republic of Lithuania, in its procedural sitting, having considered a report made by Justice Vladas Pavilonis regarding the results of the preliminary investigation in the case on the petition requesting an investigation into whether Articles 9, 93, 96, 10, and 101 of the Statute of the Seimas of the Republic of Lithuania are not in conflict with Articles 66 and 89 of the Constitution of the Republic of Lithuania, has established the following:

28 members of the Seimas of the Republic of Lithuania request an investigation into the compliance of the provisions of Articles 9, 93, 96, 10, and 101 of the Statute of the Seimas of the Republic of Lithuania regarding the number of Deputy Speakers, with Articles 66 and 89 of the Constitution of the Republic of Lithuania. However, the petition may not be considered at the Constitutional Court, because the number of the members of the Seimas who signed the petition does not meet the requirements of Paragraph 1 of Article 106 of the Constitution of the Republic of Lithuania and Paragraph 1 of Article 65 of the Law on the Constitutional Court of Republic of Lithuania. The petition was signed by 28 out of 141 members of the Seimas, whilst the law demands that the petition should be signed by at least one-fifth, i.e. by not less than 29, members of the Seimas.

Conforming to Paragraph 1 of Article 69 of the Law on the Constitutional Court of the Republic of Lithuania, the Court adopts the following decision:

To refuse to consider the petition of 28 members of the Seimas requesting an investigation into whether Articles 9, 93, 96, 10, and 101 of the Statute of the Seimas are not in conflict with Articles 66 and 89 of the Constitution of the Republic of Lithuania.
