DECISION
ON ACCEPTING THE PETITION OF A PETITIONER

The Constitutional Court of the Republic of Lithuania,
composed of the Justices of the Constitutional Court Armanas
Abramavičius, Toma Birmontienė, Egidijus Kūris, Kęstutis
Lapinskas, Zenonas Namavičius, Ramutė Ruškytė, Vytautas
Sinkevičius, Stasys Stačiokas, and Romualdas Kęstutis Urbaitis,
with the secretary of the hearingDaiva Pitrėnaitė,
in the procedural sitting of the Constitutional Court
considered the petition (No. 1B-32) of the Vilnius Regional Court
requesting to investigate whether Articles 4 and 165 of the Code
of Civil Procedure of the Republic of Lithuania (wording of 28
February 2002) are not in conflict with Paragraph 1 of Article 29
and Article 109 of the Constitution of the Republic of Lithuania.
The Constitutional Court
has established:
The Vilnius Regional Court of Lithuania, the petitioner,
was considering a civil case. By its ruling, the said court
suspended the consideration of the case and applied to the
Constitutional Court with a petition requesting to investigate
whether Articles 4 and 165 of the Code of Civil Procedure
(wording of 28 February 2002) are not in conflict with Paragraph
1 of Article 29 and Article 109 of the Constitution.
The Constitutional Court
holds that:
The petition of the Vilnius Regional Court, the petitioner,
virtually meets the requirements established in the Law on the
Constitutional Court of the Republic of Lithuania.
Conforming to Paragraph 1 of Article 102 of the
Constitution of the Republic of Lithuania, Paragraph 1 of Article
28 and Article 67 of the Law on the Constitutional Court of the
Republic of Lithuania,
The Constitutional Court of the Republic of Lithuania has
adopted the following
decision:
To accept the petition of the Vilnius Regional Court of
Lithuania, the petitioner, requesting to investigate whether
Articles 4 and 165 of the Code of Civil Procedure of the Republic
of Lithuania (wording of 28 February 2002) are not in conflict
with Paragraph 1 of Article 29 and Article 109 of the
Constitution of the Republic of Lithuania.
